Foundational Architecture Queries (FAQS)
In the world of Svedasi, we don't just answer questions. We audit the foundations.
1. "I am an NRI. Can I keep my 'Resident' Savings Account for my local expenses?"
The Svedasi Veda: Technically, no. Under FEMA, the moment your intention to stay abroad is clear, your resident accounts must be re-designated to NRO. Keeping them "Resident" is a Statutory Leak that could inadvertently signal to tax authorities that you haven't truly left. We sanitize this transition to ensure your global income stays global.
2. "Does my EPFO account stop earning interest since I no longer contribute?"
The Svedasi Veda: This is a common myth. Your EPFO continues to earn interest (currently a high-alpha 8.25%) until you turn 58. The real risk isn't the interest; it's the Access. If your KYC isn't "International-Ready," that money stays in a black box. We ensure your exit is as smooth as your entry.
3. "Can I still invest in Mutual Funds and Stocks in India as an NRI?"
The Svedasi Veda: Absolutely, but the "Plumbing" changes. You need an NRE/NRO-linked Demat and a PIS (Portfolio Investment Scheme) track. If you are trading on a Resident Demat while living in Dubai or London, you are creating a Tax Minefield. We architect the migration of your portfolio.
4. "I missed filing my tax returns for 3 years. Is my refund lost forever?"
The Svedasi Veda: Not necessarily. While standard deadlines have passed, we use surgical provisions like Section 119(2)(b) to petition for a "Condonation of Delay." As we’ve proven (see our ₹40 Lakh Resurrection case study), "Dead" assets can often be brought back to life with the right architectural force.
5. "Why do I need an Indian SIM card if I live abroad?"
The Svedasi Veda: In a Digital India, your Aadhaar-linked mobile is your "Sovereign Key." Without it, you cannot e-verify returns, update bank KYCs, or manage property transactions. Lose the SIM, and you lose command of your Indian fortress. We show you how to maintain this "Digital Anchor" globally.
6. Everyone is talking about Form 44 and mandatory CA certificates. Do I need this for my current taxes?
The Svedasi Veda: The Svedasi Sanitization: No. For the current income year (FY 2025-26), you are still governed by the Income Tax Act, 1961. You will file Form 67. The new Form 44 and its mandatory CA certification are part of the New Income Tax Act, 2025, which applies to income earned from April 1, 2026 onwards. Use this year as a "Dry Run" to get your documentation in order.
7. I live in India but have salary/dividends from Singapore. Why is my "Foreign Tax Credit" (FTC) so complicated?
The Svedasi Veda: Singapore follows a Jan-Dec tax year, while India follows April-March.
The Gap: For the Jan-March period, you won't have a final tax certificate from Singapore when it's time to file in India.
The Solution: You can rely on a Certified Estimation of taxes paid to bridge this 3-month gap. Without this "Surgical Reconciliation," the Indian Tax Department often rejects the credit, leading to 30% double taxation. It is important to note that claiming a refund on ITR U (Updated ITR) is not possible.
8. My tax consultant isn't a CA. Can they still handle my global tax filing?
They can handle the data entry for now. However, under the new rules starting in 2026, if your foreign tax exceeds ₹1 Lakh, a CA Certification (with UDIN) will be mandatory. If your current consultant isn't a practicing CA, they literally lack the "Sovereign Power" to sign your forms. You will need a Two-Vendor Strategy or a single Architect like Svedasi who handles both.
9. What happens if I miss the deadline for filing Form 67/44?
In the eyes of the Tax Department, a late claim is a Dead Claim. While some courts have allowed late filings, the automated "Centralized Processing Center" (CPC) usually denies the credit immediately if the form isn't filed before the ITR. This turns your hard-earned foreign income into a "Tax Trap" where you pay the government twice. And also leads to prolonged litigation, where relief is usually either sought at CIT or ITAT appellate levels, inviting additional costs and time lag.
10. I am relocating to India from the US this year. If my RSUs vested while I was a Resident of the US, why should I pay Tax in India when I sell them later?
The Svedasi Logic: This is the "Residency Trap." India taxes on a "Global Income" basis for Residents (ROR). However, under the New Act 2025, we use Apportionment Alpha. If you served 3 years in the US and 1 year in India during a 4-year vesting period, only 25% of that "Perquisite" value is technically taxable in India. Most generic advisors will tax the whole pie; we architect the Service Day Split to protect the 75% already earned under US jurisdiction.
11. The 24-month rule sounds great, but I need the cash now to pay the 39% Perquisite Tax on my recent vesting. Should I 'Sell-to-Cover
The Svedasi Logic: "Sell-to-Cover" is often a Tax Disaster. If you sell immediately to pay the tax, you've locked in a 39% loss on the "Perquisite" and missed the chance to turn the remaining gain into 12.5% LTCG.
The Svedasi Strategy: If your liquidity allows, pay the vesting tax from your savings. By holding the shares for 24+ months, you aren't just betting on the stock, you are betting on a 26.5% Tax Arbitrage. We help you calculate the "Break-even" to see if your cash flow can fund this tax-saving maneuver.
12. I have vested shares in a US portal, but I haven't 'brought the money' to India yet. Do I still need to report them in Schedule FA
The Svedasi Logic: Invisibility is not Immunity. Under the Black Money Act, "Non-disclosure" is a separate offense from "Tax Evasion." Even if there is zero tax due today, failing to report the Value of those vested shares can trigger a flat penalty of ₹10 Lakhs or up to 90% of the asset value. At Svedasi, we "Sanitize" your foreign filings to ensure your global portfolio is a fortress, not a liability.
13. I am staying in India for only 60 days. Isn't there a 182-day rule that protects me?
The Svedasi Insight: The 182-day rule only determines your Residential Status for global income. However, under Article 15 (Dependent Personal Services) of the DTAA, your foreign salary can become taxable in India from Day 1 if your presence is deemed to have a "Situs" in India or if your employer has a Permanent Establishment (PE) locally. Exemption is a legal claim, not an automatic right.
14. My salary is credited to my Singapore/US bank account. Why would the Indian Tax Department care?
Svedasi Insight: In the era of digital transparency, the location of payment is secondary to the location of service. If you are physically in India while performing the work, the income is deemed to "accrue" in India. Without a Sanitized Structure, you risk double taxation and FEMA non-compliance penalties.
15. What is a "Protective ITR" and why do I need it if I don't owe taxes?
Svedasi Insight: A Protective Return of Income is your formal declaration to the Indian government that you are claiming Treaty Benefits (DTAA). It acts as a legal shield. By filing it, you "close the loop" on your stay, making it much harder for the authorities to issue a notice years later based on automated travel data.
16. Can my "Work-from-India" trip really affect my foreign employer?
The Svedasi Logic: Yes. If a senior employee or an independent contractor makes key decisions while sitting in India, it can trigger a Permanent Establishment (PE) risk for the company. This could potentially expose the employer's global profits to Indian taxation. Always clear your stay with your HR/Legal team using a Svedasi Compliance Brief.
17. Is a Tax Residency Certificate (TRC) mandatory for a short stay?
Svedasi Insight: Absolutely. The TRC is the only "Sovereign Passport" the Indian Tax Department recognizes to grant you treaty benefits. Without a valid TRC from your country of residence and a digitally filed Form 10F, your claim for exemption under Article 15 will be summarily rejected.
18. I am an Independent Contractor for a US firm; am I at higher risk?
Svedasi Logic: Yes. Independent contractors have the highest "Risk Ratio." The authorities often view you as a local business providing services. To maintain your Sovereign status, you must architect your contracts correctly, ensure GST LUT (Letter of Undertaking) compliance for "Export of Services," and maintain a clinical "Days-Stay Log."
19. I am an NRI Consultant. Can I use the 50% Presumptive Tax (Section 44ADA) to simplify my filing?
Svedasi Logic: No. Section 44ADA is a benefit reserved exclusively for Resident professionals. As an NRI, you are required to compute your income on a "Net Basis." This means you must maintain books of accounts and claim actual business expenses. Filing under 44ADA as a non-resident is not permissible under the existing laws.
20. Who is strictly eligible to utilize the FAST-DS scheme?
Svedasi Logic: The scheme is designed for resident taxpayers (as well as individuals who were non-resident or not-ordinarily resident during the relevant year of asset acquisition or income accrual). This includes returning NRIs, tech professionals holding foreign ESOPs or RSUs, and former students who left behind dormant bank accounts abroad, provided their aggregate asset values fall within the scheme's monetary caps (up to ₹1 crore for untaxed assets or up to ₹5 crore for reporting omissions on already-taxed/non-resident assets)
21. Why do I need to declare a foreign asset on Schedule FA if it generated zero income?
Svedasi Logic: Under the Income-Tax Act, Schedule FA is an asset-tracking mandate rather than an income-tax schedule. If you are a Resident and Ordinarily Resident (ROR) taxpayer, the legal obligation to report foreign bank accounts, custodial holdings, or ESOPs is absolute—regardless of whether the account was dormant, generated zero interest, or sat completely empty. Failing to disclose a zero-balance asset carries the same harsh non-disclosure penalties as an income-yielding asset.
22. What is the difference between the ₹1 Lakh fee route and the 60% tax-plus-penalty route?
Svedasi Logic: The financial cost depends entirely on the source and nature of the asset. Category 1 applies to genuinely undisclosed assets or income never previously offered to tax (up to ₹1 crore), carrying a 30% tax plus a 100% penalty on that tax, resulting in an effective aggregate outgo of 60%. Category 2 applies to legacy or non-resident-era assets acquired out of legitimate, already-taxed money (up to ₹5 crore) where the wealth itself was clean but omitted from past Schedule FA filings; these qualify for a streamlined flat fee of ₹1 lakh
23. What happens if I miss the December 31, 2026 deadline and choose not to disclose?
Svedasi Logic: If you bypass the voluntary window and tax authorities independently discover an omission through automated global data-sharing networks like CRS and AEOI, all immunity protections vanish. You will face aggressive enforcement under the Black Money Act, including a recurring penalty of ₹10 lakh per year of non-disclosure, a 120% financial outgo (30% tax plus a 90% penalty), and potential criminal prosecution carrying imprisonment terms ranging from 3 to 10 years.
24. Why is my online PF withdrawal claim getting rejected automatically even though my KYC details look complete?
Svedasi Logic: Even when the digital interface looks straightforward, the EPFO backend enforces strict validation across multiple databases. A minor character discrepancy, such as a middle name format or a hyphenated surname, between your PAN, bank account, and the EPFO database will trigger an automated freeze. Furthermore, if your previous employer has delayed updating your official "Date of Exit," the portal will not allow a final settlement claim to pass.
25. Can I withdraw my PF from my current employer's account if I have an older, unmerged UAN from a past job?
Svedasi Logic: While EPFO systems sometimes permit processing a claim from the most recent active account, leaving multiple UANs unmerged creates severe long-term administrative bottlenecks and cross-verification flags. It is always best to execute an online Transfer-In request to stitch your historical records and consolidate everything into a single active UAN before initiating a final payout.
26. What happens to my PF corpus if my previous employer has shut down or refuses to update my exit details?
Svedasi Logic: If an older company is defunct or unresponsive, your funds remain trapped because online updates require formal employer sign-offs. Resolving this requires specialized intervention through offline joint-declaration channels and physical document submission, backed by formal grievance routing to force the field office to update the historical records manually.
27. How can I avoid the heavy 34.6% TDS deduction when withdrawing my PF before completing five years of service?
Svedasi Logic: If you withdraw your EPF accumulation before completing 5 years of continuous service, the system automatically triggers tax deduction at source. To prevent this steep deduction, you must ensure your PAN is actively linked and flawlessly upload a duly filled Form 15G (or Form 15H if applicable) prior to submitting your claim, certifying that your total taxable income is below the threshold limit.
